Hey GM’s - - -

This question deals with developers asking to defer payment of Quimby’s in-lieu fee from “issuance of building permit” until “issuance of certificate of occupancy” based on SB 937 (effective Jan.1, 2025).

Does your Park District have an additional or stand-alone “park impact fee” (separate from a subdivision act Quimby in-lieu fee)?

Does anyone have an attorney who has opined on the issue of whether SB 937 applies only to fees imposed pursuant to the “Fee Mitigation Act” (AB 1600) . . . or whether it would apply to a Quimby in-lieu fee as well? 

Does the SB 937 (deferral of fees) apply to stand alone or additional “park impact fee"?
